Client money protection
Rent, deposits and any other money we hold for landlords and tenants is protected by Client Money Protect, membership number CMP009942. This is a government approved client money protection scheme and membership is a legal requirement for letting agents in England who hold client money.

Tenancy deposits are protected separately with the Deposit Protection Service (DPS), a government approved tenancy deposit scheme. Every tenant receives the prescribed information for their deposit within thirty days of paying it.
Fees
Letting agents in England must publish their fees under the Consumer Rights Act 2015. AW Estate Agents Ltd is not VAT registered, so no VAT is added to any figure below.
Landlords

Tenants
Under the Tenant Fees Act 2019 the only payments a tenant can be asked for are:

| Tenancy deposit | Up to five weeks' rent where the annual rent is under £50,000. Protected with the DPS. |
| Holding deposit | Up to one week's rent to reserve a property. Counts towards the first rent or the deposit, and is refunded if the landlord withdraws. |
| Changes to the tenancy at your request | £50 per change, for example adding or replacing a tenant. |
| Late rent | Interest at 3% above the Bank of England base rate on rent more than 14 days overdue. |
| Lost keys or security devices | The reasonable cost of replacement. |
| Ending the tenancy early at your request | The landlord's reasonable costs of doing so, no more. |
No other fees are charged to tenants. Referencing, inventories, check-in, check-out and renewals are free to tenants.
Complaints procedure
Most problems get sorted with a phone call. If yours doesn't, here is the formal route.
- Tell us in writing. Email hello@andrealets.co.uk or write to Andrea Cooper, AW Estate Agents Ltd, Hudroyd Farm, Genn Lane, Barnsley, S70 6NW. Say what went wrong and what you would like us to do about it.
- We acknowledge within three working days and tell you who is dealing with it.
- We investigate and reply in full within fifteen working days. If it takes longer we will tell you why and when to expect our answer.
- If you are not satisfied, tell us and Andrea Cooper, as director, will review the complaint and send you our final viewpoint letter within fifteen working days.
- If you are still not satisfied, or eight weeks have passed since your complaint without a final viewpoint, you can refer it to the Property Redress Scheme, free of charge, within twelve months of our final viewpoint letter. We keep a written record of every formal complaint and what was done about it.
Privacy notice
AW Estate Agents Ltd, trading as Andrea Lets, is the data controller for the personal information we hold. We are registered with the Information Commissioner's Office, registration number Z2721435. We hold personal information about landlords, tenants, guarantors, applicants, contractors and anyone who contacts us. This notice explains what we collect, why, and your rights under the UK General Data Protection Regulation and the Data Protection Act 2018.
What we collect
- Contact details: name, address, phone, email, date of birth.
- For tenants and applicants: right to rent documents, identity documents, employment and income details, references, credit and referencing checks, bank details for rent, benefit details where rent is paid by Universal Credit or housing benefit, and details of the people living at the property.
- For landlords: property details, ownership, mortgage lender and insurance details where relevant, bank details for rent payments, and identity checks.
- Records of the tenancy: agreements, inventories, inspection reports, repair reports, correspondence, rent accounts and deposit records.
- If you use the contact form on this website: your first name, phone or email, and your message.
Why we use it and the lawful basis
- To let and manage property, collect rent, arrange repairs and deal with the tenancy from start to finish (performance of a contract).
- To meet legal duties: right to rent checks, deposit protection, gas and electrical safety, anti money laundering checks, tax and accounting records, and requests from local authorities and the courts (legal obligation).
- To run the business: keeping records, dealing with complaints, protecting property and people, and defending legal claims (legitimate interests).
- To answer your enquiry when you contact us (legitimate interests, or steps before a contract).
We do not sell personal information and we do not use it for automated decision making.
Who we share it with
- Landlords and tenants of the property concerned, so far as needed to manage the tenancy.
- Referencing and credit check providers, and previous landlords or employers, when you apply for a property.
- The Deposit Protection Service, for tenancy deposits.
- Contractors and tradespeople, so they can carry out repairs and safety checks.
- Utility companies and the council, for changes of occupier and council tax.
- Our lettings software and email providers, who hold data on our behalf under contract.
- Accountants, solicitors, insurers, mortgage lenders, the courts, the police and government bodies where the law requires or allows it.
How long we keep it
Tenancy and landlord records are kept for six years after the tenancy or the management agreement ends, because that is how long claims can be brought and how long tax records must be kept. Unsuccessful applications are kept for twelve months. Enquiries from this website are kept until dealt with.
Your rights
You can ask for a copy of the information we hold about you, ask us to correct it, ask us to delete it where we no longer need it, object to or restrict certain uses, and ask for it in a portable form. Email hello@andrealets.co.uk. We answer within one month. If you are unhappy with how we handle your information you can complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.
